What Is a Payment Default?
A payment default is recorded on your credit file when a creditor (such as a bank, telco, or utility provider) reports that you have failed to pay a debt of $150 or more, and the debt is at least 60 days overdue. Once listed, a default remains on your file for 5 years — even if you pay it off.
Defaults can cause:
- ❌ Rejection of home loan or car loan applications
- ❌ Higher interest rates or deposits required
- ❌ Difficulty renting property
- ❌ Declined credit card applications
How We Investigate Your Default
Under the Privacy Act 1988 and the Credit Reporting Code, creditors must follow specific steps before listing a default. These include:
- Providing a correct Section 21D notice (default notice) giving you at least 30 days to respond
- Ensuring the debt is accurately stated and correctly attributed to you
- Confirming the correct reporting procedures were followed
- Verifying the listing is within the correct time limits
Our specialists personally review every default against these requirements. Where we identify a procedural or substantive breach of the Privacy Act 1988 or Credit Reporting Code, we lodge a formal dispute with the credit reporting body (Equifax, Experian, or Illion) and/or the creditor directly.
What We Check
✅ Section 21D default notice — was it sent correctly?
✅ Correct address — was the notice sent to the right place?
✅ Debt amount — is it accurately stated?
✅ Correct attribution — is it really your debt?
✅ Updated status — paid/settled correctly reflected?
✅ Time limits — is the listing within allowed timeframes?

Frequently Asked Questions
Can paid defaults be removed?
Yes. Whether a default has been paid or not does not affect whether the listing was lodged correctly. If the creditor failed to follow the proper process under the Privacy Act 1988, the listing may be challenged regardless of whether it has been paid.
How long does the process take?
The investigation and dispute process typically takes 30 to 90 days, depending on the complexity of the case and how quickly the credit reporting body and/or creditor responds. We keep you updated throughout the process.
What information do I need to provide?
We’ll need your full name, date of birth, and permission to obtain a copy of your credit file. If you have any correspondence from the creditor about the default — such as the original default notice — that is also helpful but not always required.
What are my chances of success?
We only accept cases where we believe there are genuine grounds for dispute. We do not guarantee removal — results depend on the specific circumstances of your case. However, our thorough investigation approach means we only proceed when we believe the grounds are solid.
Can I dispute a default myself for free?
Yes, you can lodge a dispute directly with the credit reporting body or the creditor at no cost. However, preparing an effective dispute requires knowledge of the Privacy Act 1988, the Credit Reporting Code, and the specific grounds that credit reporting bodies accept. We handle this professionally.
